Applies to: TerraAqua software, firmware, applications, cloud services and distributed software packages

1. Purpose

TerraAqua products and services may include software developed by third parties and software distributed under open-source licences. This notice explains how those components are acknowledged and how applicable licence rights are preserved.

2. Open-source components

Open-source software may be included in ReefCore controller software, firmware, TerraAqua Cloud, websites, applications, build systems, development tools and official sensor-node software.

3. Separate licence terms

Each open-source component remains subject to its own licence. The relevant licence terms apply to that component and may grant rights to use, copy, modify, redistribute or obtain source code.

If an open-source licence conflicts with the TerraAqua EULA for the relevant component, the open-source licence takes priority for that component.

4. No transfer of third-party ownership

TerraAqua does not claim ownership of third-party open-source software. Copyright remains with the identified authors and rights holders.

Where an applicable open-source licence requires TerraAqua to provide corresponding source code or a written source-code offer, TerraAqua will make that material available in the manner and for the period required by the licence.

A reasonable charge covering the physical cost of providing a copy may apply where the licence permits it.

To request open-source licence information or source code covered by an applicable offer, email info@terra-aqua.co.uk and identify the TerraAqua product, model and software version.

8. Modifications

Where required, notices will identify whether TerraAqua modified an open-source component. TerraAqua modifications are provided under the terms required by the applicable licence.

9. Attribution

Names, trade marks and project names associated with open-source software remain the property of their respective owners. Inclusion does not imply endorsement of TerraAqua by those projects or rights holders.

10. Warranty disclaimers

Open-source licences commonly provide software without warranty from the original authors. Those disclaimers apply to the extent stated in the relevant licence. They do not remove any separate statutory obligation or warranty that TerraAqua owes to a customer for a TerraAqua product.

11. Product-specific notices

Because component lists change between versions, the authoritative notices for a particular installation are the notices shipped with, displayed by or published for that product and software version.

Software not identified as open source remains proprietary to TerraAqua or its licensors and is governed by the End User Licence Agreement or another applicable commercial licence.

13. Compliance

TerraAqua aims to review software dependencies, retain licence and copyright information, satisfy attribution requirements and meet source-distribution obligations associated with the open-source components it distributes.

14. Errors and omissions

If you believe an attribution, licence text or source-code offer is missing or inaccurate, notify TerraAqua so that it can be investigated and corrected.
