1. Introduction

These Terms & Conditions govern your use of TerraAqua products and services. By accessing or using a TerraAqua service, you agree to these Terms.

These Terms apply to the TerraAqua website, My TerraAqua, TerraAqua Cloud, ReefCore Controllers, TerraAqua mobile applications, online services, customer support and future online purchases. If you do not agree, you must not use the services.

2. About TerraAqua

TerraAqua provides aquarium monitoring, automation and connected cloud services in the United Kingdom.

3. Definitions

Account means a registered TerraAqua customer account. Controller means a TerraAqua ReefCore Controller. Cloud Services means services provided through TerraAqua Cloud. Subscription means a paid TerraAqua Cloud service. Products means hardware or software supplied by TerraAqua. Services means any online or offline service supplied by TerraAqua.

4. Eligibility

You must be at least 18 years old or use TerraAqua under appropriate adult supervision. You are responsible for the security of your account.

5. Your account

You agree to provide accurate information, keep passwords secure, keep contact details current and notify TerraAqua promptly if your account may have been compromised. You remain responsible for activity carried out through your account.

6. ReefCore Controllers

ReefCore assists with aquarium monitoring and automation. It is not a substitute for regular maintenance, inspection or supervision. You remain responsible for livestock health, equipment maintenance, water quality, safe installation and suitable emergency procedures.

7. Cloud Services

Cloud Services may include remote monitoring, remote control, notifications, historical data, device management and premium features. Internet availability cannot be guaranteed and interruptions may occur during maintenance, faults or outages.

8. Local operation

ReefCore is designed to continue operating locally where possible if internet connectivity or Cloud Services are unavailable. Cloud-dependent features will not be available while disconnected.

9. Subscriptions

Some services require an active subscription. Fees are displayed before purchase. Subscriptions may renew automatically unless cancelled. Cancellation normally takes effect at the end of the paid billing period.

10. Orders

When online ordering is available, orders are subject to acceptance, availability and the price confirmed during checkout. A contract is formed only when TerraAqua accepts the order.

11. Product availability

TerraAqua may improve, update or discontinue products, specifications and services. Changes made after purchase do not remove applicable statutory rights.

12. Software updates

TerraAqua may provide security updates, firmware updates, bug fixes and feature updates. Some updates may be required for continued security or compatibility.

13. Acceptable use

You must not misuse the services, attempt unauthorised access, interfere with security, distribute malware, disrupt systems or reverse engineer software except where applicable law expressly permits it.

14. Intellectual property

Software, firmware, product designs, graphics, logos, documentation and website content remain the property of TerraAqua or the relevant rights holder. Purchasing a product does not transfer intellectual-property ownership.

15. Third-party services

TerraAqua may integrate with third-party providers. Their availability, terms and privacy practices are outside TerraAqua's direct control.

16. Warranty and returns

Hardware warranty claims are governed by the Warranty Policy. Returns, cancellations and refunds are governed by the applicable Returns & Refund Policy when published.

17. Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded. To the maximum extent permitted by law, TerraAqua is not responsible for indirect or consequential loss, livestock loss, loss of profits, loss of business or loss of data caused by misuse, incorrect installation, equipment outside TerraAqua's control or failure to follow instructions. Customers remain responsible for suitable monitoring, safeguards and backup arrangements.

18. Events outside our control

TerraAqua is not responsible for delay or failure caused by events outside its reasonable control, including power or internet failure, natural events, third-party infrastructure incidents, cyberattacks or government action.

19. Suspension and termination

TerraAqua may suspend or terminate access where necessary to address fraud, security risk, unlawful use or a material breach. Reasonable notice will be given where practical unless immediate action is required.

20. Privacy

Personal information is handled as described in the Privacy Policy.

21. Changes

TerraAqua may update these Terms. Material changes will be published in the Legal Centre and, where appropriate, communicated to registered users.

22. Governing law

These Terms are governed by the laws of England and Wales. Courts in England and Wales have jurisdiction, except where mandatory consumer law provides otherwise.
