Definitions & Interpretation
Applies to: All TerraAqua Legal Centre documents, products and services
1. Purpose
This document provides standard definitions and interpretation rules used across the TerraAqua Legal Centre. A policy or contract may define an expression differently for its own purposes. Where it does, the specific definition takes priority for that document.
2. Defined terms

| Account | A customer, user or administrator account used to access My TerraAqua, TerraAqua Cloud, an application or another protected TerraAqua service. |
| Application | An official TerraAqua mobile, web, desktop or embedded software application. |
| Authorised User | A person whom the account holder or customer permits to use a product, account or service. |
| Business Customer | A person or organisation acting wholly or mainly for purposes relating to a trade, business, craft or profession. |
| Cloud Service | TerraAqua-hosted functionality, including remote access, synchronisation, storage, account services, notifications and subscription features. |
| Consumer | An individual acting wholly or mainly outside their trade, business, craft or profession. |
| Content | Text, images, data, configuration, readings, documents, software, communications or other material. |
| Controller | A ReefCore Controller or another official TerraAqua control device. |
| Customer | A person or organisation that purchases, subscribes to, registers for or otherwise lawfully receives a TerraAqua product or service. |
| Customer Data | Information, readings, configuration, files or other content submitted to or generated through a TerraAqua service for a customer. |
| Device | A controller, sensor node, power unit, phone, tablet, computer or other hardware used with TerraAqua software or services. |
| Documentation | Official manuals, setup instructions, specifications, notices, help material and safety information supplied or published by TerraAqua. |
| Firmware | Software installed on a controller, node, power unit or other embedded device. |
| Legal Centre | The collection of current TerraAqua legal policies, terms, notices and statements published on the TerraAqua website. |
| My TerraAqua | The TerraAqua customer account, cloud dashboard or related account-management service. |
| Node | An official TerraAqua sensor, monitoring or control node connected to ReefCore. |
| Order | A request accepted by TerraAqua for the supply of goods, digital content or services. |
| Personal Data | Information relating to an identified or identifiable individual, as defined by applicable data-protection law. |
| Product | A TerraAqua-branded or TerraAqua-supplied physical product, digital product, software package or accessory. |
| ReefCore | The TerraAqua aquarium-controller product family and associated official software, firmware and compatible services. |
| Service | A TerraAqua website, account, cloud, subscription, support, digital or other service. |
| Software | TerraAqua applications, controller software, firmware, interfaces, updates and related code or documentation. |
| Subscription | A recurring paid arrangement for specified TerraAqua Cloud or application features. |
| TerraAqua, we, us or our | The TerraAqua business identified in the relevant contract, order confirmation or legal notice. |
| User, you or your | The person using, accessing, purchasing or receiving a TerraAqua product or service, as the context requires. |
| Website | The official TerraAqua website and pages operated under TerraAqua-controlled domains. |
3. Headings
Headings are for convenience and do not affect interpretation.
4. Singular and plural
A reference to the singular includes the plural and vice versa where the context permits.
5. Including
The words “including”, “includes”, “such as” and similar expressions are illustrative and do not limit the words that come before them.
6. Written communication
A reference to writing includes email, account messages, website notices and other durable electronic communication unless a document specifically requires another form.
7. Days and time
A reference to a day means a calendar day unless stated otherwise. A business day means a day other than Saturday, Sunday or a public holiday in England.
Times are local United Kingdom time unless the relevant page, service or communication specifies another time zone.
8. Laws and regulations
A reference to legislation includes amendments, replacements, subordinate legislation and legally binding guidance in force from time to time, unless the context requires reference to a particular version.
9. Documents incorporated by reference
Where one TerraAqua policy links to or expressly incorporates another, both documents should be read together.
10. Priority
Unless mandatory law requires otherwise, the following order of priority applies where documents conflict:
- a specific signed or expressly accepted written agreement;
- the applicable order confirmation or quotation;
- product-specific or service-specific terms;
- the main Terms & Conditions;
- other Legal Centre policies; and
- general website or marketing information.
11. Consumer protection
No interpretation should be used to remove or reduce a mandatory consumer right.
12. Severability
If a provision is unlawful or unenforceable, it will be treated as modified to the minimum extent necessary or removed, while the remaining provisions continue in effect where legally possible.
13. No waiver
A delay or failure to enforce a right does not waive that right. A waiver applies only to the specific circumstances for which it is given.
14. Language
The English-language version controls unless mandatory local law requires otherwise. Translations may be supplied for convenience.
